Terms and Conditions for Recruitment Service
(Payment on Placement)

These terms and conditions between Websearch Recruitment Limited (hereinafter referred to as Websearch) and the client (herinafter referred to as the Client) are deemed to have been accepted once the Client has asked Websearch to introduce an Applicant for permanent employment or fixed term contract employment, or the Client has agreed to engage or make use of such an Applicant in any position of employment or work.  Introductions shall include without limitation the provision by Websearch of any details whether oral or written of the Applicant for permanent or fixed term contract work.  These terms and conditions shall not apply to Clients using the Websearch Advertising Service which has its own Terms of Business.
 
 

PERMANENT STAFF

1. The Client shall notify Websearch immediately a candidate introduced by Websearch is engaged.
 
2. On engagement of a candidate introduced by Websearch the Client will be required to pay the appropriate introduction fee within 14 days of the date of Websearch’s invoice.
 
3. If the Client, without first notifying Websearch, engages a candidate in any capacity within twelve months of the candidate being introduced by Websearch, or if the Client or a member of the Client’s staff refers a person introduced by Websearch to some other person or body and that other person or body engages the candidate in any capacity whether Temporary, permanent or self-employed, the Client will be liable for an introduction fee for permanent staff at the prevailing rate based on the fixed fee applicable at the time of registration of the vacancy, without entitlement to a rebate.  (Interest at the rate of 2% per calendar month or part thereof will be applied from the date of appointment until payment of the invoice without concession).
 
4. Websearch endeavours to ensure the suitability of any Applicant introduced to the Client by obtaining confirmation of the Applicant’s identity; that the Applicant has the experience, training qualifications and any authorisation which the Client considers necessary or which may be required by law or by any professional body; and that the Applicant is willing to work in the position which the Client seeks to fill.
 
4.1 The Client shall satisfy itself as to the suitability of the Applicant and The Client is responsible for the taking up of references as to the candidate’s qualifications, capabilities, integrity, medical history, and suitability to obtain a work permit for the candidate wherever necessary.
 
4.2 To enable Websearch to comply with its obligations under clauses 4, and 4.1 above, the Client undertakes to provide to Websearch details of the position which the Client seeks to fill, including the type of work that the Applicant would be required to do; the location and hours of the work; the experience, training, qualifications and any authorisation which the Client considers necessary or which are required by law or any professional body for the Applicant to possess in order to work in the position; and any risks to health or safety known to the Client and what steps the client has taken to prevent or control such risks.  In addition the client shall provide details of the date the Client requires the Applicant to commence, the duration or likely duration of the work, the minimum rate of remuneration, expenses and any other benefits that would be offered; the intervals of payment of remuneration and the length of notice that the Applicant would be entitled to give and receive to terminate the employment with the Client.
 
5. Websearch can accept no liability whatsoever for any loss, damage costs or expenses howsoever caused which the Client may suffer or for which the Client may become liable arising out of or in connection with or as a result of the introduction to the Client or the engagement by the Client of an Applicant.
 
 

FIXED TERM CONTRACTS

6. If the Client engages an Applicant on a fixed term contract through Websearch  the Client will pay a fixed introduction fee to Websearch and will pay the Applicant invoices direct or will pay a 15% margin of the Applicant’s rate for the duration of the Contract at the choice of the Client.  Fixed fee rates are:

Contract Duration 0-3 months - £500+ VAT
Contract Duration 4-6 months - £1000 + VAT
Contract Duration 6+ months - £1,500 + VAT.
 
7. Fixed term contracts attract no rebate facility.
 
 

INTRODUCTION FEES

8. Our fixed fee is £1,500 + VAT for the introduction of a Permanent member of staff.  The fee for introducing an Applicant on a fixed term contract is a fixed one-off fee of £1,500 + VAT  or 15% margin of the Applicant’s rate for the duration of the Contract at the choice of the Client. 
 
 

GUARANTEES OF SATISFACTION

9. In the event of a candidate leaving the Client’s employment within 12 weeks of commencement for any reason other than through redundancy, provided that the Client informs Websearch in writing of the fact within seven days of termination, and the invoice has been paid in accordance with clause 2, we shall endeavour to seek one replacement at no extra cost to the client.
 

10. If we are unable to find a replacement, the Client shall receive a rebate against the fee paid, which shall be calculated as a proportion of the introduction fee as follows:

1-4 weeks = 100% rebate
5-8 weeks = 50% rebate
9-12 weeks = 25% rebate

Scale of refund

The above scale of refund only applies in the event that the Client complies with the provisions of clause 2 of these Terms of Business or where the Client has agreed to comply with a variation of these terms already agreed in writing.
 
 

CANCELLATION FEES

11. If, after an offer of Engagement has been made to the Applicant, the Client decides for any reason to withdraw it, the Client shall be liable to pay Websearch the original introduction fee.
 
 

THESE TERMS AND CONDITIONS OF BUSINESS ARE EFFECTIVE FROM 1st APRIL 2008

These Terms constitute the contract between Websearch and the Client and are deemed to be accepted by the Client by virtue of an Introduction to, or the Engagement of an Applicant or the passing of any information about the Applicant to any third party following an Introduction.  These terms contain the entire agreement between the parties and unless otherwise agreed in writing by Websearch, these Terms of Business prevail over any other terms of business or purchase conditions put forward by the Client. No variation or alteration to these Terms shall be valid unless the details of such variation are agreed between Websearch and the Client and are set out in writing and a copy of the varied terms is given to the Client stating the date on or after which such varied terms shall apply. VAT is payable on all charges at the prevailing rate.

Websearch reserves the right to charge interest on all late payment of invoices raised from the date of the due invoice until the date of payment calculated at the rate of 2% per calendar month or part thereof. If any employee or applicant introduction of Websearch is engaged by the Client on a Temporary, Permanent or Self-employed basis these Terms of Business will apply and the Client will be liable to Websearch for an introduction fee equivalent to the normal permanent fee.

These Terms are governed by the law of (England & Wales/Scotland/Northern Ireland) and are subject to the exclusive jurisdiction of the Courts of (England &Wales/Scotland/Northern Ireland)

 
 
 Terms and Conditions for Websearch Recruitment Advertising Service (Payment Up Front)

The signature and return to Websearch Recruitment Ltd (Websearch) of the Websearch order form will be deemed an acceptance by the client of the terms and conditions set out below.

1.      The total value of the order will be invoiced on receipt of the signed order form.

2.   The total fee will be as agreed with the Websearch account manager and the client and will be included on the order form for agreement and signature by the client.

3.      The fees quoted for service A and service B cover the following:

a.      Service A: We guarantee the vacancy will be advertised for two weeks on a specified list of Internet job boards, as agreed with the client; the vacancy will be advertised for a further two weeks but not necessarily on all the specified job boards and, in some cases, on a different set of job boards; the total advertising period is four weeks.

b.      Service B: We guarantee the vacancy will be advertised for four weeks on a specified list of job boards, as agreed with the client; the total advertising period is for four weeks.

  1. The fee payable shall be for copywriting and placing an advertisement of the client’s vacancy on various Internet job boards to attract applicants; receiving applicant responses; replying appropriately and passing on information about the vacancy; making applicants available to the client by forwarding emails or giving access to view and download online; analysing responses; and providing the client with statistics showing applicant source.
  2. Websearch will advertise each vacancy on a minimum of seven relevant Internet job boards or on those websites as listed on the order form in the case of tailored advertising campaigns. The Internet advertising will start within one working day of the receipt of the signed order form and job description. The vacancy will also be included on the Websearch online searchable vacancy database on www.websearchrecruitment.com.
  3. If screening is selected, Websearch will produce screening criteria to be approved by the client and will screen all candidates according to the agreed vacancy criteria. The client will be provided with a list of all applicants who have failed to reach acceptable screening levels and the client can choose to receive specific applicant CVs if required. If screening is not selected, Websearch will forward to the client all original CVs in reply to the vacancy.
  4. Websearch will perform on-line psychometric testing of candidates, if requested by the client. The results of the test will be free for the first six candidates chosen (for each vacancy skill set) and charged at £6.00 per test thereafter.

8.      Each candidate forwarded shall have expressed an interest in the vacancy.

  1. Whether candidates are engaged on a temporary, contract or permanent basis no further fees will be payable by the client beyond the prior agreed initial fee.
  2. Payment terms are 14 days from date of invoice. Failure to pay within the agreed terms may result in the service being suspended.
  3. These Terms are governed by the law of (England & Wales/Scotland/Northern Ireland) and are subject to the exclusive jurisdiction of the Courts of (England &Wales/Scotland/Northern Ireland)
